Youth Council

Article I Duties of Officers

Section 1:  It shall be the duty of the Chairperson to preside at all meetings of the Youth Council.

Section 2:  In the place of the Chairperson, the Vice-Chairperson shall preside and shall have all the duties, powers, privileges and duties of the regular Chairperson.

Section 3:  It shall be the duty of the Youth Council Secretary to keep a true and accurate record of all minutes, to render proper records at all meetings of the Youth Council, and to an accurate record of all Councils proceedings, including minutes of each special and regulatory meeting.  All records shall be kept in a compartment of Youth Council.  The Secretary shall inform all members of meetings or cancellations of any meetings issued by Youth Council.

Section 4:  The duties of the Treasurer of the Youth Council shall be as follows:  he/she shall accept, receive and receipt for preserve and safeguard all funds in custody of the Youth Council, whether same be Youth Council funds or special funds for which the council is acting as trustee or custodian to.  He/she shall deposit all funds in a bank, as directed by council and shall report in writing all receipts, expenditures, accounts and the nature of all funds in custody, one a month to Youth Council, or at any time requested to do so.

Section 5:  The Sergeant of Arms is in charge of regulating meetings and other youth events or affairs and shall assist all other officers as directed.

Section 6:  All other members of Youth Council shall be appointed a position by the Chairperson or Vice-Chairperson of council, and shall assist others in their duties and replace them in their absence.

Article II  Qualifications for Office

Section 1:  Any person to be elected into the Youth Council must be a Tule River resident, and with in the age limits of twelve through twenty-four years of age.  The Youth Council shall be the sole judge of qualifications of it's members.

Article III Conduct or Elections and Certifications

Section 1:  It shall be the duty of Youth Council to see that each nomination for council, including membership in council, shall be mad in strict accordance with the provisions of the Constitution, and shall certify as the legality of such nominations, otherwise it shall be considered illegal and be in effect by council.

Section 2:  All youth elections for officers shall be canvassed and certified by the council or by a board appointed by the council within three days after such elections, no candidate shall be considered legally nor shall they hold office until such canvas and certification has been made by council.

Section 3:  All necessary details concerning youth nominations and elections not specifically referred to in this Constitution & Bylaws shall be more fully set forth in ordinance to be hereafter by the council.

Article IV Meetings and Procedures

Section 1:  Immediately after the election of members of Youth Council and when the elected members are citified as provided for in Article III of the Constitution, the members shall assemble and organize for business.

Section 2:  The council shall regularly meet each Tuesday of every week, and hold a public meeting every last Tuesday of every month.

Section 3:  At any special or regular meeting of council, two-thirds of the council shall constitute a quorum and with out such a quorum  the Chairperson shall adjourn the meeting.

Section 4:  Special meetings of the council shall be held at such times that are designated by the Chairperson, or by written request of three council members, or by petition of fifty youth, such written requests shall be filed by the Secretary or Chairperson of council.

Section 5:  All meetings of council (except executive) shall be open to the public, balloting at all meetings will be done by roll call, or by rising of hands or via voice.  The council may upon motion duly passed go into executive session, all persons directly concerned with the matter under discussion shall be excluded from the council chambers and any such person whose presence shall be requested before council shall be designated by the Chairperson and no other persons shall be allowed to be present other than the members of council.

Section 6:  The order of business and any special or regular meeting of Youth Council shall be as the following

  • Council called to order

  • Roll Call

  • Reading of the previous minutes

  • Report of standing committees

  • Treasure report

  • Special committees report

  • Reading of communications report

  • Old/New business

  • Adjourned

Section 7:  It shall be the duty of the council to exercise care and caution to the end that a complete record is preserved, all the acts of Council all of the committees appointed by the council, accurate records of all necessary records shall be transmitted to such departments as may be necessary.

Section 8:  All records of the council and it's comities or delegates shall be at all times a matter of public record, and any member of the tribe or their authorized representative or any other properly authorized office or employee of any government agency shall have full access to same during regular business hours, exception of executive sessions.

Section 9:  Copies of all leases, contracts, deeds or assignments and all other papers and documents pertaining to any nature on the Reservation shall be carefully preserved by the council, and duplicates of such documents shall be deposited in the files of the agency.

Article V Attendance and Meeting Progress

Section 1:  Because attendance plays such a big role in business, the council shall apply these rules:

  • Officers shall attend all meetings if possible or will be given notice of removal from council.

  • Officers missing three meetings in a row will automatically be removed from council

  • If councilmen accused is not satisfied of such, they may  plead their case at a designated council meeting.

Section 2:  If the officer is not going to be present at any meeting of the Council they must notify the Secretary of Council or an official of Council

Section 3:  If any pattern of absence shall occur, Council shall take the removal of such an officer into consideration and decide on removal from office.

Section 4:  If any person does not make a productive effort within a Council meeting, they shall be taken into consideration for removal from office.

Section 5:  Any person under the influence of any substance shall be removed from the Council chambers, if it's a councilmen under the influence the council shall take action against such an officer and decide on a proper sentence.

Section 6:  Any Council officer more than thirty minutes tardy shall be considered absent from meeting unless presented a good explanation.  The Council will decide if the accused will take an absence from the meeting.

Section 7:  If any vacancy is declared, the Council shall follow the Vacancy and Removal from Office procedures, Article IV of the Constitution.
