Youth Council

We the members of the Tule River Youth of the Tule River Indian Reservation in the state of California, in order to establish a Youth Council to further the educate our youth in tribal government, and to conserve our traditions, to develope our community resources, to administer justice and promote the welfare of our youth and descendants.  We do herby ordain and establish this Constitution and Bylaws of the Tule River Youth, to serve as a guide for the liberation of Youth Council in it's administration to youth "tribal" affairs.

Article I Membership

Section 1:  The members of the Tule River Youth Council shall consist of the following.

a.  All persons of Indian blood with in the age limits of twenty four enrolled in the Tule River Indian Reservation, Year to date.

b.  All the children born to a tribal member, when reached the age of twelve, may join the membership of the Youth Council

Article II The Governing Body

Section 1:  The Governing body of the Tule River Youth shall consist of a council known as the Tule River Youth Council.

Section 2:  The Tule River Youth Council shall be composed of nine youth elected by secret ballot.

Section 3:  The Tule River Youth Council so organized shall elect from it's own membership, a Chairperson and a Vice-Chairperson, and form within it's own membership a Secretary, Treasurer and a Sergeant of Arms, and such other officers and committee's as may be deemed necessary.

Section 4:  The nine elected members of the council shall remain in office for a term of two years or until their successors are elected.

Section 5:  The nine members in office a one year term will elect five members to stay with in the office of council.  The four members which are not elected for council must reapply at own will.  An election will be held to fill the four remaining positions of council.  This step will be taken to establish a five four stagger of council.

Article III Nominations

Section 1:  The first election of Youth Council under this Constitution shall be called, held and supervised by the present Youth Council, after the ratification and approval of this Constitution; and there after, elections shall be held every two years on the last Friday in January.

Section 2:  Any qualified youth member of the tribe may announce his or her candidacy for the Youth Council by notifying the Secretary in writing prior to the election.  To be eligible for membership of Youth Council, a candidate must have reached his or her twelfth birthday, and be a qualified voter of the Tule River Youth Council.  The Duty of the Secretary will be to post the names of all candidates whom have met these requirements, at least five days before elections.

Section 3:  The Youth Council, or a board appointed by the Youth Council, shall determine rules and regulations governing elections, and shall certify to  the election of members of the Tule River Youth Council, within three days after the election returns.

Section 4:  Any member of the Tule River Youth, that is twelve years of age and under twenty five on the date of election and who has maintained legal residency for at least one year continuously prior to elections, on the Tule River Indian Reservation shall be entitled to vote.

Article IV Vacancies and Removal of Office

Section 1:  If a council person, or other officials, shall die, resign, permanently leave the reservation or be removed from office for cause, the Youth Council shall declare the office vacant and appoint a successor to fill the unexpired term.

Section 2:  If a council person, who is proven guilty of improper conduct, or gross neglect of duty, may be expelled from the Youth Council by a two-thirds vote of the council, provided that an accused member shall be given full opportunity to respond to any and all charges at a designated Youth Council meeting; and provided further that the accused member shall be given a written statement of the charges against him/her, at least five days before the meeting at which he/she will be given the opportunity to reply.

Article V Power and Duties of Youth Council

Section 1:  The Tule River Youth Council, subjected to any limitations imposed by the statutes or Constitution of the United States, and subjected to all express restrictions upon such powers as are set forth in this Constitution and Bylaws, shall have the following powers to value existing Tribal Law and Acts set forth by Tribal Council.

  • To enter into negotiation with organizations for youth affairs on behalf of the Tule River Youth.

  • Be Present and observe any claims or demands of the Tule River Youth, to assist youth in any way capable and to represent demands in youth affairs.

  • To approve or to veto any sale, disposition, lease of youth assets which may be authorized by Tribal Council, Secretary of the Interior, Commissioner of Indian Affairs or any other official of the government.

  • To administer any funds or property with in the control of Youth Council, to make expenditures of funds for the youths public purposes, subject that a majority of council by vote, shall approve the expenditures in a legal manner.

  • To require individual members of Youth Council or others to assist with community labor when just cause or extreme emergency exists.

  • To create and maintain a youth fund by accepting grants or donations from any person, stat or the United States or by levying assessments money will be passed by a majority of Council.

  • To adopt resolutions regulating the procedures of Youth Council and Youth officials within limits of the Youth Council.

Section 2:  The Council of the Tule River Youth may exercise such powers as may in the future be delegated to the Youth Council by the Tule River Tribal Council or by any other duly authorized official or agency of government.

Section 3:  Any right and power here vested in the youth of the Tule River Reservation but not expressly written in this Constitution shall not be abridged by this article, but may be exercised by the youth of the Tule River Reservation through the adoption of appropriate Bylaws and Constitutional Amendments.

Section 4:  The Tule River Youth Council shall be free of any authority, exception of Tribal Council, and shall be under no organization or person in which shall try to over run it or over see it, and shall be run on the youth will and no other way.
